User Agreement
1. TERMS AND DEFINITIONS USED IN THIS AGREEMENT
The following terms, within the framework of this Agreement, have the following meanings:
1.1. Website – the entirety of all information (textual and graphical) available on the Internet at the address propolis.kz, owned by the Individual Entrepreneur «BMS»
1.2. Website Administration – employees of the IE «BMS», authorized to modify the information on the Website
1.3. Website User (hereinafter referred to as the User) – an individual utilizing the Website of IE «BMS»
1.4. Parties – IE «BMS» and the User of the Website who have entered into this Agreement
2. GENERAL PROVISIONS
2.1. This User Agreement (hereinafter referred to as the Agreement) applies to the IE «BMS» Website, located on the Internet at the address propolis.kz
2.2. The Website is the property of the IE «BMS»
2.3. This Agreement governs the relationship between IE «BMS» and the Website User
2.4. IE «BMS» reserves the right to change, add, or delete clauses of this Agreement at any time without notifying the User
2.5. Continued use of the Website by the User constitutes acceptance of the Agreement and any amendments made to it
2.6. The User is personally responsible for checking the Agreement for any changes
2.7. This Agreement comes into force as soon as the User expresses their consent to its terms. By viewing the Website or completing the registration procedure, the User is deemed to have accepted the terms of the Agreement in full, without any reservations or exceptions
3. SUBJECT OF THE AGREEMENT
3.1. The subject of this Agreement is to provide the User with access to the information and online services presented on the Website
3.2. The Website provides the User with the following types of services: Free access to textual and graphical information with the right to view it; Access to search and navigation tools on the Website; An opportunity for the User to request prices, services, reviews, and other information (feedback); Access to information about services, special offers, bonuses, and discounts; Ordering of services
3.3. This Agreement applies to all currently existing services of the Website, as well as any modifications and services that may appear in the future
3.4. Access to the Website is provided free of charge
3.5. This Agreement is a public offer. By accessing the Website, the User agrees to the terms of the Agreement and is deemed to have joined this Agreement
3.6. The use of the materials and services of the Website is regulated by the applicable laws of the Republic of Kazakhstan
4. RIGHTS AND OBLIGATIONS OF THE PARTIES
4.1. IE «BMS» has the right to:
4.1.1. Modify the rules for using the Website, as well as its content. Changes take effect from the moment the updated version of the Agreement is published on the Website
4.1.2. Restrict access to the Website or its sections if the User violates the terms of this Agreement
4.2. The User has the right to:
4.2.1. Access and use the Website for informational and similar purposes, as well as access online services presented on the Website
4.2.2. Ask any questions related to the services provided on the Website or other information published on the Website, using the «Contact Us» section
4.2.3. Use the Website exclusively for purposes and in a manner provided by this Agreement and not prohibited by the laws of the Republic of Kazakhstan
4.3. The User is obligated to:
4.3.1. Respect the property and non-property rights of authors and other rights holders when using the Website
4.3.2. Refrain from actions that could disrupt the normal functioning of the Website
4.3.3. Not disseminate, via the Website, any confidential or legally protected information about individuals or legal entities under the laws of the Republic of Kazakhstan
4.3.4. Avoid any actions that may breach the confidentiality of information protected under the laws of the Republic of Kazakhstan
4.3.5. Not use the Website for distributing advertising materials
4.3.6. Not use the Website's services to: Upload content that is illegal or infringes the rights of third parties; promotes violence, cruelty, hatred, and/or discrimination based on race, nationality, gender, religion, or social characteristics; contains false information and/or insults directed at individuals, organizations, or authorities. Encourage unlawful actions or assist individuals engaged in activities violating restrictions and prohibitions in effect within the Republic of Kazakhstan. Violate the rights of minors and/or harm them in any form. Impersonate another person, or a representative of an organization and/or community without sufficient authority, including impersonating the Website Administration. Mislead others about the properties and characteristics of any service presented on the Website. Make inappropriate comparisons of services or create a negative attitude toward individuals using/not using certain services or criticize such individuals
4.4. The User is prohibited from:
4.4.1. Disrupting the proper functioning of the Website
4.4.2. Bypassing the Website's navigation structure to obtain or attempt to obtain any information, documents, or materials by means not intentionally made available through the Website's services
4.4.3. Gaining unauthorized access to the Website's functions, other systems or networks related to the Website, or any services offered on the Website
4.4.4. Breaching the security or authentication system on the Website
4.4.5. Monitoring or attempting to monitor any information about other Website Users
4.4.6. Using the Website for purposes prohibited by the laws of the Republic of Kazakhstan, as well as inciting illegal activities or other activities violating the rights of IE «BMS» or other persons
5. USE OF THE WEBSITE
5.1. The Website may not be copied, published, reproduced, transmitted, or distributed in any way, in whole or in part, without prior written consent from IE «BMS»
5.2. The Website is protected by copyright, intellectual property rights, and unfair competition laws
5.3. Online presentation on the Website do not require user registration
5.4. The User is personally responsible for maintaining the confidentiality of their information and for all activities conducted on behalf of the User without exception
5.5. This Agreement applies to all additional terms and conditions for the provision of services offered on the Website
5.6. The information published on the Website should not be interpreted as a modification of this Agreement
5.7. The Website Administration reserves the right to modify, at any time and without prior notice, the list of services offered on the Website and the prices applicable to those services
5.8. The document titled «Privacy Policy» governs and applies to the User's use of the Website as relevant
6. LIABILITY
6.1. Any losses incurred by the User due to intentional or careless violation of any provision of this Agreement, as well as unauthorized access to another User's communications, are not compensated by IE «BMS»
6.2. IE «BMS» is not liable for:
6.2.1. Delays or disruptions in operations caused by force majeure events, as well as any malfunctions in telecommunications, computer, electrical, or other related systems
6.2.2. Actions by transfer systems, banks, or payment systems, and delays associated with their operations
6.2.3. Improper functioning of the Website if the User does not have the necessary technical resources for its use, nor does IE «BMS» bear any obligations to provide such resources to Users
7. VIOLATION OF THE TERMS OF THE USER AGREEMENT
7.1. IE «BMS» has the right to disclose any information collected about the User if such disclosure is necessary in connection with an investigation or complaint regarding improper use of the Website or to identify the User who may violate or interfere with the rights of IE «BMS» or other Users of the Website
7.2. IE «BMS» has the right to disclose any information about the User deemed necessary to comply with applicable laws or court orders, ensure the enforcement of this Agreement, or protect the rights of Users
7.3. IE «BMS» is entitled to disclose User information if required or permitted by the applicable laws of the Republic of Kazakhstan
7.4. IE «BMS» may terminate access to the Website without prior notice to the User if the User has violated this Agreement or the terms of use of the Website contained in other documents, as well as in cases of Website termination or technical malfunctions
7.5. IE «BMS» is not responsible to the User or third parties for the termination of access to the Website in the event of the User's violation of any provision of this Agreement or other documents containing terms of use of the Website
8. DISPUTE RESOLUTION
8.1. In the event of any disagreements or disputes between the Parties to this Agreement, filing a claim (a written proposal for voluntary dispute resolution) is a mandatory prerequisite before court proceedings
8.2. The recipient of the claim must, within 30 calendar days from the date of its receipt, notify the claimant in writing of the results of the claim review
8.3. If a dispute cannot be resolved voluntarily, either Party has the right to apply to the court for the protection of their rights as provided by the applicable laws of the Republic of Kazakhstan
8.4. Failure to comply with the terms of this clause will result in any claims or grounds for claims being subject to statutory limitations
9. ADDITIONAL TERMS
9.1. IE «BMS» does not accept proposals from Users regarding amendments to this User Agreement
9.2. User feedback and questions posted on the Website are not considered confidential and may be used by IE «BMS» without restrictions
